Outsourcing--An Economic Trade Solution!

NAFTA & RECONCILIATION--U.S. Import Trade
Compliance Solutions!
|

Are you NAFTA compliant? Did you
know that the most common reasons for companies receiving NAFTA penalities and fines are
incorrect HTS product classification, not having a valid NAFTA certificate at the time
of import, and/or not maintaining sufficient backup analysis and
recordkeeping requirements. You can reduce your company's compliance risk by performing your own
internal NAFTA Compliance Assessment or
request support from a professional by contacting Dann.
If you happen to be a Mexican IMMEX company or
support an IMMEX company, then you will probably want to consider
carefully how you prepare and manage the process that results in Reconciliation. According
to the Reasonable Care requirements found in U.S. Trade laws, the U.S.
importer is responsible for having and maintaining written internal procedures, policies, and
controls which govern your company's process of determining
valuation for all imported items, including those products falling
under computed valuation.
A CBP auditor recently reminded me that their first responsbility when
beginning an audit is 1) ensure
that written internal procedures are available, and 2) make sure that the written
procedures have evidences of being used. Most likely, the
demands of your operation leave little time for preparing written

CBP Issues A Strong Alert to C-TPAT Companies on July 22,
2009 (Request a copy of the complete article)

What is the value
of your C-TPAT status? How would your business be different if you
had a security breach or incident? CBP indicates that there have
been quite a few recently, especially along the Southwest
Border. Give it some careful thought! There are a
lot of examples of "security breaches or incidents" that do
affect the C-TPAT status of many C-TPAT validated companies. If you
are one of those unfortunate companies, one of the first things that CBP
will do before pulling your C-TPAT status immediately is to
ascertain whether or not your company has been doing what it
said it would do by meeting the minimum-security criteria requirements
established by CBP. One
of those "must" requirements is to conduct on an annual basis a
comprehensive internal assessment of its international
supply chain security status using the miminum-security criteria for
C-TPAT certified companies. If you
do in fact have a security breach, and you have records to
prove that you have been doing what CBP has required, you may
possibly not have your C-TPAT status removed. Isn't that incentive enough to schedule your
annual C-TPAT Internal Assessment? Contact Dann to

has met its annual C-TPAT Minimum Security criteria
requirements.

Important ISF (10+2) Updates Issued by CBP on July 17,
2009 (Request CBP ISF Derective)
|
|
Clarification of
ISF Mitigation Guidelines for Liquidated Damages were published in the
CBP Bulletin Vol 43, July 17, 2009, No 28. There are four ISF situations that could cause the
issuance of liquidated damages to your company:
1) Importers failure
to file an ISF as required by law, 2)
a late ISF submission, 3)
an inaccurate ISF submission, and 4)
the failure to withdraw an ISF. There is a possibility of a total
of $10K in liquidated damages per ISF filing. CBP will
consider mitigating those $$ penalties downward, only if the importer
meets one of the 6 mitigation
factors outlined by CBP in this
publication. Evidence
of progress in implementing ISF compliance during the phase-in period
which began on Jan 26, 2009 and Being a C-TPAT Tier 2 or Tier 3 Importer are two
of the mitigating factors that you will want to make sure that your
company is doing. You will want to make sure that you know
what these mitagating factors are and that your company is meeting all of
them, otherwise you will face serious $$ "Risk" for
the future. If you think that your company has not begun issuing
ISFs for each of its ocean import shipments, then you will want to
immediately contact Dann for advice and recommendations.

C-TPAT Eligibility for a Third Party Logistics (3PL)
Provider
|
|
With CBP's strong emphasis for importers and Foreign
Manufacturers to encourage their Business Partners to pursue C-TPAT
status, this is a perfect time for 3PL providers to begin pursuing that
process right now. Some of CBP's
eligibility requirements are 1) involved in cross border business, 2)
maintain a staffed office in the U.S., 3) and be licensed or
bonded. There are a few other requirements and if you or your
3PL provider is interested, contact Dann to
see if you qualify, and if not, Dann will let you know what you need
to do, so that you will qualify.

Using ACE Reports Can Add Value To Your Business
|
|
Did you know
that the ACE Reports can significantly add value to your business?
Not only do they provide information that allows you to detect compliance
issues, but they also allow you to manage your trade (entry data, duty
payments, bonds, emanifests, etc.) data and activity. Unfortunately
most companies that have access to ACE are not aware of all the reports
and data that can significantly enhance their business. Are you one
of those ACE companies that fall into this description? You may
want to investigate how you can take advantage of the resources available

Mexican Long Haul Highway
Carriers Are Now C-TPAT Eligible
|
|
There are many
Mexican manufacturers and U.S.
importers that will increase the security of their supply chains by
having their Mexican Long Haul Highway Carriers C-TPAT certified.
You will strengthen your own supply chain by encouraging one of your
own business partners, who is 1) an active long haul carrier in Mexico,
2) does not cross the border with cargo destined for the U.S., and
3) has an SCT No. issued by the Mexican Secretaria de Transportes y
Comunicaciones to call or email Dann to see if they are eligible.
